Immediately upon discovery of a theft or significant loss of CS, a pharmacy must contact the nearest Drug Enforcement Administration (DEA) field office by telephone, fax, or brief written message explaining the circumstances. The pharmacy shall also complete DEA Form 106 (report of theft or loss of CS), which can be obtained by contacting the nearest DEA diversion field office. The pharmacy must send the original completed DEA Form 106 to the appropriate DEA diversion field office and keep a copy for its records. Copies should also be forwarded to the Department of HHS Regulation and Licensure and the Nebraska State Patrol. Although the term “significant loss” is not defined, it is up to the individual registrant to use his or her best judgment and take the appropriate action. The DEA Form 106 must include the following information: (1) name and address of the pharmacy; (2) DEA registration number; (3) date of theft or loss; (4) name and telephone number of the local police department notified; (5) type of theft; (6) listing of symbols or cost codes used by the pharmacy in marking containers, if any; and (7) listing of CS missing from theft or significant loss.
