Missouri News: Waivers Required to Employ Certain Individuals

Any pharmacy or drug distributor who employs or wishes to employ an individual who has entered a plea of guilty, no contest, nolo contendere, or otherwise been convicted of a criminal controlled substance (CS) violation must obtain a waiver before granting the person access to any CS. A waiver is required for this individual indefinitely. If the violation was a misdemeanor, a waiver must be obtained from the Missouri Bureau of Narcotics and Dangerous Drugs (MO BNDD). If the violation was a felony, a waiver must be obtained from the MO BNDD and the federal Drug Enforcement Administration (DEA). If the individual’s violation was a misdemeanor, MO BNDD will not issue a waiver allowing the individual to have access to CS for at least two years. If the individual’s violation was a felony, MO BNDD will not issue a waiver allowing the individual to have access to CS for at least seven years. Waivers must be requested and obtained in writing and signed. A waiver request must include justifications for the request, explain what access the individual will have to CS, and include a job description at the registered location where the waiver is being sought. Any waiver request made within the time restrictions noted above for employment, must also provide what specific guarantees will be made to ensure that the person for whom the waiver is sought will have no access to CS.
