Kentucky Law Bans Classes of Synthetic Drugs
A new law in Kentucky bans entire classes of synthetic drugs, with the broader language intended to prevent producers from developing new formulas for the dangerous products often marketed as “bath salts” and “incense.” Kentucky Governor Steve Beshear stated that the “measure will curtail underground chemists from tweaking a formula to get around a ban on a specific chemical substance and will go a long way toward protecting our communities and our families.” The law also “extends seizure and forfeiture laws to retailers who sell the items, makes sales a felony for a second or subsequent offense, and makes simple possession a misdemeanor” as indicated in the press release from Governor Beshear’s office. Under the new law, offenders can be fined an amount double to the gain they would have made by selling the products.
