Illinois Pharmacists' Right to Refuse Dispensing Emergency Contraceptives Upheld by Appellate Court
The court decision allowing pharmacies and pharmacists in Illinois to refuse dispensing emergency contraceptives on religious grounds was upheld by an Illinois appellate court on Friday, September 21, 2012. Dispensing of emergency contraceptives was mandated under a rule implemented by former Illinois Governor Rod Blagojevich in 2005, but the rule was overturned in April 2011. The appellate court upheld the lower court’s decision, agreeing that the “Illinois Health Care Right of Conscience Act protects pharmacists' decision not to dispense the contraceptives due to their beliefs,” as indicated in a Reuters article.
