FDA and FTC Warn Company Marketing Unapproved Product Claimed to Treat Flu
With high rates of flu across the country, FDA in conjunction with the Federal Trade Commission (FTC) took action to help protect consumers from an unapproved product marketed to treat the flu. The agencies sent a joint letter to Flu and Cold Defense LLC warning that because of claims made on the company’s Web site, its product GermBullet is an unapproved drug and that marketing it is illegal. Among other claims, the company’s Web site falsely indicates that "An FDA recognized virology lab independently tested GermBullet® inhalation blend and confirmed that it has the potential capability to kill cold and flu viruses." However, FDA indicates that the agency has not "recognized" any virology lab that has independently tested the company’s product. The letter noted other violations and indicated that failure to promptly correct the violations may result in legal action.
