Act May Exempt Certain Pharmacies From DMEPOS Accreditation
While DMEPOS accreditation is required for suppliers who wish to obtain Medicare Part B billing privileges for products and services that are subject to CMS’s quality standards, the March 23, 2010 enactment of the Patient Protection and Affordable Care Act, may exempt pharmacies that already have such privileges from the requirement if they:
- have had a Part B billing number for at least five years and have had no adverse determination due to fraud for the last five years;
- submit an attestation that its total Medicare DMEPOS billings are and continue to be less than a rolling three year average of 5% of total pharmacy sales; and
- are willing to submit documentation to the Secretary of Health and Human Services (based on a random sample of pharmacies) that would allow the Secretary to verify the information in the documentation submitted or could consist of an accountant certification or filing of tax returns by the pharmacy.
At this time, however, CMS has not defined how a pharmacy can obtain exemption from the DMEPOS accreditation requirement.
